Welcome to the Gym Management application ("the App"), developed and operated by IotaBuild ("we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not use the App.

1. Description of Service

The App is a platform designed to facilitate gym management, including but not limited to attendance tracking via QR codes, membership and subscription management, payment tracking, and fitness progress logging (body measurements). The App serves both gym administrators/owners and individual gym members.

2. User Accounts

  • Account Registration: To use the App, you must register for an account. You must provide accurate, complete, and current information.
  • Security: You are responsible for safeguarding your password and any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Account Termination: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

3. Acceptable Use

You agree not to use the App to:

  • Violate any applicable national or international law or regulation.
  • Impersonate any person or entity, including gym administrators or staff.
  • Interfere with or disrupt the security, integrity, or performance of the App.
  • Upload or transmit viruses, malware, or any other type of malicious code.

4. Health and Fitness Disclaimer

The App is a management and tracking tool, not a medical device or a substitute for professional medical advice.

  • The body measurement tracking and fitness data logged within the App are for personal tracking purposes only.
  • You should consult with a physician or other qualified healthcare provider before beginning any new fitness program or making changes to your diet based on data tracked within the App.
  • IotaBuild is not responsible for any injuries, health problems, or damages that may result from your use of the fitness facilities managed through this App.

5. Payments and Subscriptions

  • Gym Members: Payment obligations, membership fees, and refund policies are strictly between you and your specific gym facility. IotaBuild merely provides the software to log and track these payments and assumes no liability for billing disputes, refunds, or service cancellations at your physical gym.
  • Third-Party Gateways: Any digital payments processed through the App are handled by secure third-party payment processors. We do not store your raw credit card information.

6. Intellectual Property

The App and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of IotaBuild and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of IotaBuild.

7. Limitation of Liability

In no event shall IotaBuild, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any conduct or content of any third party (including gym facilities) on the App.
  • Any unauthorized access, use, or alteration of your transmissions or content.

8. Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
